Overview

For students involved in a wide range of industries, it is important to have a fundamental understanding of the Australian legal system. In this unit, students will be introduced to several aspects of the law that are relevant to industry, including the sources of law (both cases and legislation), parliament and the court hierarchy, negligence, forms of business organisation, contract law, consumer law, and property law. This unit will support students as they prepare for their future role in industry.

Learning Outcomes

On successful completion of this unit you will be able to:

  1. Identify and communicate the fundamental principles that underpin the Australian legal system and its institutions, including parliament and the court system
  2. Identify and explain a range of laws relevant to industry
  3. Apply legal principles to problem scenarios relevant to industry
  4. Present legal concepts clearly and in plain English through written communication.

Content

In this unit you will learn about: 

  • the Australian legal system;
  • sources of law (cases and legislation);
  • parliament and the court hierarchy;
  • forms of business organisation;
  • contract law;
  • consumer law;
  • negligence; and
  • property law.

Learning Approaches

This unit employs an active and collaborative approach to learning and is taught using a blended approach. On Canvas, you will complete a program of online materials and activities that introduce you to a range of key concepts about the Australian legal system. During in-person or online workshops, you will apply legal principles to realistic scenarios using a case study approach.

Your participation in this unit will include:

  • engagement with online materials on Canvas;
  • participation during in-person or online workshops; and
  • a court visit (in-person or online).

You will be provided with feedback to assist your learning throughout the semester. The feedback is provided through:

  • discussions during in-person or online workshops;
  • feedback on workshop tasks;
  • individual feedback provided on assessment with the completed Criteria Referenced Assessment form;
  • generic feedback posted on the unit's Canvas for each item of assessment; and
  • the option of consultation with a member of the teaching team.

Assessment in this unit is both summative (ie designed to give you feedback and linked to your assessment) and formative (ie designed to provide you with feedback and not linked to your assessment).

Assessment Tasks

Assessment: Reflective journal

You will be required to view a sitting of an Australian Court and provide a personalised account of that sitting, outlining your observations. 

This assignment is eligible for the 48-hour late submission period and assignment extensions.

Assessment: Assignment

The assignment will require you to provide a written response to a problem-style question. The assignment will assess the extent to which you have a broad knowledge and understanding of the principles underpinning the legal system, your ability to interpret and analyse sources of law relevant to industry, and your ability to recognise legal problems and apply legal principles to solve these problems. 

This assignment is eligible for the 48-hour late submission period and assignment extensions.

Assessment: Examination

The examination will be an online exam with questions that will cover material from across the whole unit. Questions may be multiple choice and/or require short answers.
